By using WinWrx - the app, the website, the games and the giveaways - you agree to this policy and to our terms of service. We may change them, and continuing to use the service means the current version applies. You can stop using it at any time.

WAY-EZ Terms of Service

By using the WAY-EZ app or website (the "Service"), you agree to the following terms and conditions ("Terms"). Please read them before using the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence if greater, to hold an account. When you create an account you provide your date of birth and confirm that you meet this requirement; accounts that do not are refused. Some features, including the games and the giveaways, are unavailable in certain states; the Service tells you where a feature is not offered.

3. Account Registration

You may hold one account, registered to a phone number or email address that you control. You agree to provide accurate information and to keep it current. You are responsible for activity under your account. We may close accounts that duplicate another, that are used by someone other than their holder, or that are used to circumvent limits on the Service.

4. Community Standards

Parts of the Service are public: the name you choose to post under, the picture on your account, and the comments you leave are seen by other customers. You are responsible for all three. You agree not to post anything that is sexually explicit, that depicts nudity or graphic violence, that is hateful, threatening or harassing toward any person or group, that is spam or a scam, that impersonates anyone or publishes another person's private information, or that is otherwise unlawful. The same standard applies to a name as to a comment. You also agree not to engage in any illegal activity, interfere with the Service or other users, use automated means to interact with the Service, or violate any applicable law or regulation.

Other customers can report you, and WAY-EZ reviews reports. Enough reports about a comment or a picture hide it while it is reviewed. After review, WAY-EZ may leave things as they are, hide a comment, remove a picture (you will be asked for another), replace a name that breaks these standards with a generic one (you will be told; the replacement is permanent), issue a notice in the Service, suspend your ability to comment, or close your account under Section 11. These are WAY-EZ's decisions, made in good faith, and are not a finding of fact about you. Reports and the decisions made on them are kept as described in the Privacy Policy; the identity of a person who reports you is not disclosed to you.

Some comments shown in the Service were posted on WAY-EZ's channels on other platforms, such as YouTube, and are shown here as they appear there. You may report those too. Enough reports about one hide it from the Service without further review; that does not remove it from the platform it was posted on, and WAY-EZ does not review or contact the person who posted it.

5. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information. By using the Service you agree to it.

6. Intellectual Property

The Service and its content, features and functionality are the property of WAY-EZ and its licensors, including Winwrx, and are protected by copyright, trademark and other laws.

7. Product Sales

We offer physical and digital products for sale through the Service. By placing an order you agree to provide accurate and complete information and to pay the price shown, plus any applicable tax and shipping.

8. Shipping and Delivery

Orders are subject to availability. Delivery times vary by location and method. WAY-EZ is not responsible for delays caused by carriers or other factors outside its control.

9. Returns

You may return a product within 30 days of delivery for a refund or exchange, in its original condition and packaging, following the instructions given when a return is approved. Return shipping is your responsibility unless the product is defective or the return results from our error. Digital products, entries and rewards are not returnable.

10. Refunds

Refunds are issued to the original method of payment within 14 business days of receiving a returned product. The Entries earned on a refunded or returned order are deducted from your account, whether or not they have been used; your balance may go below zero, and rewards you earn afterwards go toward it until it is above zero again. Store credit and membership credits used on the order are returned as credit.

11. Termination

We may suspend or terminate your access to the Service for conduct that violates these Terms or is harmful to other users, the Service or WAY-EZ. Rewards in a terminated account are forfeited.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

13. Limitation of Liability

To the fullest extent permitted by law, WAY-EZ, Winwrx and their affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising from your use of or inability to use the Service.

14. Governing Law

These Terms are governed by the laws of the State of Oregon without regard to conflict-of-law principles. Disputes are resolved in the courts located in Portland, OR, except as the Official Rules of a giveaway provide otherwise for disputes about that giveaway.

15. Changes to the Terms

We may modify these Terms. If a change is material we give at least 30 days' notice before it takes effect. Continued use of the Service after a change takes effect is acceptance of it.

17. Rewards Program

The Service includes a rewards program with two kinds of reward, Points and Entries, and free plays of its games. Rewards are a promotional benefit of using the Service. They have no cash value, are not money, property or a deposit, are not transferable between accounts, cannot be sold, and cannot be redeemed for cash. They do not expire, but they are forfeited when an account is closed under Section 11. We may correct a balance that results from an error, a technical failure or misuse, and we may change or end the program, or any reward's value or use, on 30 days' notice; rewards already in your account keep the uses available to them at the time of the change until it takes effect.

• Plays. Every game in the Service may be played free, up to a daily limit that is the same for every customer. After the first few plays each day, a play is preceded by a short advertisement, which a membership removes. Plays are never sold, never come with a purchase, and are never awarded by chance.
• Points are a score. They are earned by playing the games, by checking in and by activities offered in the Service - never by a purchase. Their only use is to obtain Entries from the Redeem shelf at the rate shown there.
• Entries are used to enter giveaways under that giveaway's Official Rules, which govern their use in it. Section 18 describes how they are obtained.

18. Giveaway Entries

No purchase is necessary to obtain entries or to win a giveaway. Entries are obtained free by checking in daily, by the activities offered in the Service and by mail as each giveaway's Official Rules describe; with a purchase of a product marked as earning them; by redeeming Points; and, where offered, by purchasing an entry pack. A purchase does not improve your odds of winning over the free methods. Purchased entries and entries obtained with Points are not refundable and have no cash value. If a giveaway is cancelled before its drawing, entries used in it are returned to your account. Entry packs are available only where WAY-EZ's payment processor permits their sale, and may be withdrawn at any time; entries already in your account are unaffected.

19. Games

The games in the Service are free to play, for entertainment, and award Points only. They never award plays, Entries or anything of monetary value. How each game pays, and the odds of each outcome, are shown on the game. No purchase is necessary to play, and nothing you buy changes what a game pays, how often you may play, or your chances: the daily limit is the same for every customer, and a membership removes advertisements and adds designs and nothing else. Games are offered only in states where they are permitted and are unavailable elsewhere.

A gift card sold in the Service may be offered for less than its value and may earn Entries on the amount paid, as shown on the offer; what the card is spent on earns Entries as any purchase does. Gift cards cannot be bought with Points.

20. Memberships

WAY-EZ may offer paid memberships. What a membership costs, what it includes, when it renews and how to cancel are set out in the Membership Terms, which are shown to you and accepted by you when you join and which govern your membership. In summary: a membership renews automatically each billing period at the price shown until you cancel, you may cancel at any time in the Service and cancellation takes effect at the end of the current period, you may change plan at any time - a move to a dearer plan takes effect at once and is charged the difference for the rest of the period, a move to a cheaper one takes effect at your next renewal - and discount credits are a benefit of membership rather than a purchased balance - granted at the start of each period, lapsing at the end of it, with no cash value. Points and Entries cannot be used to buy, upgrade or discount a membership.

21. Store Credit and Gift Cards

Gift-card balances entered on your account are store credit. Store credit is spent like cash on the Service, never expires, carries no fees, is returned as store credit on a refund, and is not redeemable for cash except where the law requires.
